Benefits to Plan Sponsors
While plan sponsors may elect to act as their own trustee, Paychex offers directed trustee services through a third party, Mid Atlantic Trust Company, for plans with 80 or more employees. Services include:
401(k) plans are funded through a trust established to hold and invest the plan’s assets. At least one trustee is appointed to have responsibility for the activities of the trust and its assets. This is a serious responsibility with considerable potential for liability.

The 3(16) fiduciary is responsible for the day-to-day administration, including:
• Signing and filing Form 5500 • Monitoring plan operations • Distributing annual notices • Approving distributions and loan requests
3(16) Plan Administration
The 3(21) Co-Fiduciary will provide a list of investments appropriate for use in retirement plans from which you can choose. This is more of a “help me do it” approach because the plan sponsor still maintains some liability as the main fiduciary by approving the fund lineup.
